What you need to realize is that just because you were issued a summons for a traffic offense does not mean that you have to plead guilty.  In fact, even if you may have committed the offense, the prosecutor still has to prove that you committed the offense, which is not always that easy to do.

Why do you need a lawyer?

If you plead guilty to a charged traffic violation you are subjecting yourself to potential penalties that you may never have thought of before you plead guilty.  Most times after you plead guilty to the initial charge it is too late to stop the spiral effect.

  • Pleading guilty could result in your insurance rates going up due to surcharges
  • Pleading guilty may prevent you from getting a good job, or losing your current job

What can a lawyer do for you?

The average person is at a disadvantage when disputing a traffic ticket that charges them with a violation of the law and the prosecutor knows this.  The average citizen is not a threat to the prosecutor because most citizens lack knowledge in both the procedure and the substantive nature of law to effectively challenge a violation.  Because of this, the average citizen is not in a good position to get the best result when disputing a ticket.  When a lawyer is hired to represent the interests of the client, the scenario changes because the lawyer has the knowledge of the law.  But more importantly, the lawyer will negotiate with the prosecutor after carefully reviewing all aspects of the prosecutor’s case, such as reports, witness statements, and evidence.  This does have an effect on the prosecutor because now the prosecutor must decide if the case is strong enough to withstand the scrutiny of the judge after the lawyer exposes any errors or omissions that conflict with the law.

With court dockets overflowing with cases, a prosecutor will be more inclined to negotiate with a lawyer that demonstrates a strong awareness of the facts and commanding knowledge of the law.  Although results cannot be guaranteed, the standard result is a favorable plea bargain agreement that results in a lesser charged offense (lower points / no points), or a complete dismissal.
